The Micro Offering Exemption That Entrepreneurs Hope For

 

Rep. Thomas Emmer, R-Minn., has introduced legislation (H.R. 4850) that would create a micro-offering exemption described below; the reason for it are stated here.

When a company would like to sell stock, it must register with the Securities and Exchange Commission, unless an exemption applies, per the Securities Act. It’s estimated by the Securities and Exchange Commission that registration costs $2.5 million dollars in legal, accounting and other expenses. So registration is not an option for small companies.

Since the federal securities laws were first enacted in 1933, “transactions by an issuer not involving any public offering” have been exempt.

But the problem is that there is no definition of a public offering or, conversely, of what is not a public offering in the Securities Act (or in the securities regulations). A non-public offering is called a private placement or private offering.

 Thus, in principle, a few guys forming a small little business (a local restaurant or retail store) who are a little too public in seeking investors can run afoul of the securities laws. This wouldn’t be that hard to do, for example, one of them telling a local reporter about their plans when they run into him at the local high school football game could break the rules. Mentioning your plans on the internet could cause you serious legal problems.

In the hyper-litigious country we inhabit and given the potentially catastrophic impact that aggressive enforcement of the law would entail, it is appropriate to create a bright line, per se safe harbor for very small offerings.

If you are raising a small amount of money from a few people most of whom you know already, you should not have to hire a securities lawyer, do a private placement offering memorandum, comply with Regulation D and file a SEC Form D or otherwise risk being pursued by federal or state regulators, or more likely, being successfully sued by disgruntled investors if the business fails or does not have the hoped for returns.

Small, and usually young, businesses are the source of most net job creation and much of the dynamism in the economy.

To reduce regulatory impediments to small business formation and growth, Congress should create a micro-offering exemption. It should create a safe harbor so that any offering (within a 12 month period):

(1) to people with whom the issuer (or its officers, directors or 10 percent or more shareholders) has a substantive pre-existing relationship;

(2) involving 35 or fewer other persons;

(3) or of less than $500,000 is deemed not to involve a public offering.

The anti-fraud provisions of federal and state laws should remain fully applicable.

This legislation would reduce the regulatory burden and legal risk imposed on small entrepreneurs by the securities laws and promote economic growth and job creation.

Bolton on Email Issue: Will Politics Beat Lawlessness

Speaking in a radio interview on Sunday, John Bolton, former U.S. ambassador to the United Nations, stated he believes the FBI will “explode” if Hillary Clinton ultimately is not indicted for her email infractions due to what he described as politics triumphing over the legal system.

Bolton was being interviewed for “Aaron Klein Investigative Radio,” broadcast on New York’s AM 970 The Answer and Philadelphia’s NewsTalk 990 AM.

Klein, who doubles as Breitbart’s Jerusalem bureau chief and senior investigative reporter, asked Bolton whether he thinks Clinton will ultimately be indicted for allegedly sending classified information over her private email server.

“I think that the pressure is definitely building,” Bolton responded. “And just take the politics out of this for a second. What Hillary Clinton and her top aides did is not just make a few small violations of laws to protect classified information. They made wholesale violations and they did it for a sustained, indeed for a four-year period.”

He continued:

So this is a far more serious than what happened to General Petraeus. And it’s one reason why I think that both the FBI and I believe the people in the Justice Department, the prosecutors who would oversee the handling of the case, are moving more and more to the conclusion that serious indictments are warranted here.

Now it’s possible that in this administration that politics can triumph over the legalities. But I think if that does happen, there’s a real risk for Obama and for the Attorney General that the FBI will explode. And a lot of things that we don’t know about, that are not on the public record at the moment, will come on the public record.

It may not be the same thing as firing Archibald Cox (the discharged Special Prosecutor) in the Watergate investigation, but if this potential prosecution is tanked for political reasons, it will be a very loud explosion.  And it will stain Obama’s legacy forever. It will damage Loretta Lynch’s professional reputation and I think it will have a profound impact on the presidential election, as well.

THE SUPREME COURT AND THE HYPOCRISY OF THE LEFT

Lately I’ve been arguing with lefty acquaintances of mine who say, “Isn’t it terrible for the Republicans to play tit-for-tat over Court nominations” that surely they don’t seriously expect Republicans never to reciprocate for the shameful treatment of Republican judicial nominees, starting with Bork. Over 50 Bush judicial nominees were never given a hearing, let alone a vote—and not just in the final year in office. Democrats blocked a hearing for Miguel Estrada for several years (because a conservative Hispanic terrified Democratic Party racial uniformity enforcers). And let’s not forget Obama’s willingness to filibuster each of George W. Bush’s two Supreme Court nominees. Obama has no standing to complain about the treatment of Judge Garland.

Moreover, if you consult the basic literature of game theory, you’ll see that “tit-for-tat” is exactly how you should respond to a second party who is trying to gain advantage over you: only through a taste of their own medicine will the first party moderate its behavior.

But let’s not forget the original sin of this problem: the Democrats’ shameful behavior in the Bork nomination in 1987. No, I’m not willing to let this go, because it represented a dramatic change in the rules of judicial politics. Pottery Barn rule time: Democrats broke it—they need to own it.

Forget Joe Biden and his “rule” from 1992. Here’s Sen. Joe Biden, chairman of the Senate Judiciary Committee, in 1987:

“Say the administration sends up Bork, and, after our investigation, he looks a lot like another Scalia. I’d have to vote for him, and if the groups tear me apart, that’s the medicine I’ll have to take. I’m not Ted Kennedy.”

It didn’t take long for “the groups” to get to Biden, however, so much so that the theWashington Post raised an editorial eyebrow at Biden’s extraordinary stance, noting that it would be hard for Bork to get a fair hearing when the Judiciary Committee chairman “has already cast himself in the role of a prosecutor instead of a juror.”

Let’s not forget that Bork had been approved unanimously by the Senate for the DC Circuit Court of Appeals. So much for that Garland talking point.

There is nothing in the Constitution that says the Supreme Court has to be nine members. (See: FDR, 1937. Heh.) If they want to, Republicans could insist on simply not filling vacancies and shrinking the Court through retirements or deaths. I suspect Democrats will come to this position next time a Republican president wants to replace a liberal justice with a conservative justice. Might as well just blow it up now.

While we’re at it, let’s also recall the sheer anti-intellectualism and evasions of Democrats in the Bork fight. As Suzanne Garment commented at the time in the Wall Street Journal:

The irony here is large. For a long time now liberals in America have denounced conservatives for anti-intellectualism and represented themselves and the institutions they control, like universities and the courts, as preservers and defenders of intellect. In the Bork campaign they acted with a contempt for intellect at least as bad in its way as anything that came out of the fundamentalist Right of the 20s.

 

Trump Lies, the Noun and the Verb

Donald Trump began his post-primary press conference in Jupiter, Florida, Tuesday evening by castigating the “$38 million dollars worth of horrible lies” against him by his political opponents over the last week. But in true Trump form, the GOP frontrunner delivered a litany of lies, falsehoods, and misleading statements of his own. Oh, and that $38 million figure Trump cited? It’s made up.

Mitt Romney’s speech last week blasting Trump for his underwhelming business record seems to have gotten under the candidate’s skin, and so Trump spent much of his Tuesday-night appearance boasting about his successes. Over at Mashable, Jonathan Ellis documents how much of what Trump said was simply wrong.

Trump Steaks? A defunct brand since 2007 that sold poorly in the first place, which explains why the meat being hawked at Trump National Golf Club as the real deal was actually from a local, non-Trump-affiliated butcher. Trump Water? Standard bottled water with the Donald’s branding. Trump Magazine? The actual publication closed down years ago, and the magazine Trump waved around at his press conference is actually a “glorified brochure” for Trump’s resort properties. Trump Airlines? Trump claims he sold it in a “great deal,” but the Wall Street Journal showed his attempt in 1989 to transform Eastern Airlines’s shuttle business into a luxury airline failed because it carried a “high debt load” and “eventually defaulted.”

Trump Vodka? Trump dismissed Romney’s criticism by ignoring it and talking instead about Trump Winery. To be fair, Trump Winery is a real, operating venture, but that’s as far as the truth goes. Trump claimed to own the winery in Charlottesville, Virginia, “100 percent”, but in fact Trump’s son Eric is the actual owner and neither Trump himself nor his organization have no ownership or management role. And the winery isn’t next to the Thomas Jefferson Memorial, as he claimed Tuesday—that’s in Washington, D.C. He was probably thinking of Jefferson’s home in Charlottesville, Monticello, on which the memorial was modeled. And none of this addressed Trump Vodka, which is indeed defunct.

The truth is Ellis just scratched the surface of Trump’s lies and misleading statements Tuesday. Many of them were small or insignificant. Trump claimed New Jersey governor Chris Christie, who has endorsed him, was “around here somewhere.” But spokesman for the governor told the Asbury Park Press that Christie was elsewhere in Florida Tuesday and not attending the Trump event in Jupiter. Trump also said House speaker Paul Ryan “called me” earlier in the week, but the Wisconsin Republican’s office confirmed to THE WEEKLY STANDARD that Ryan’s phone call came after Trump’s campaign first reached out to the speaker.

Others gave more inaccurate assessments of Trump’s professional success. Trump described his Riverside South housing development on Manhattan as “one of the most successful projects in all of real estate.” That’s hard to believe. A recent New York Times article instead characterized Riverside South as a “low point” in Trump’s New York real-estate career. The development, which stretches from 72nd Street to 59th Street along the Hudson River, “encountered ferocious opposition from neighborhood groups and city planners,” the Times reported. “Saddled with debt, Mr. Trump in 1994 was forced to bring in outside investors and eventually lost control over the project, though he says he made money on it.”

Some of Trump’s untruths were much bigger and consequential, like one that bolsters his oft-repeated but dubious claim that he will be able to beat Hillary Clinton in a general election with ease. “Polls are showing that I beat her, and some of the polls are showing that I beat her very easily,” he said.

Why then, does the Real Clear Politics average of polls asking about a general-election match-up between the two give Clinton a five-point lead? Of the 48 polls asking about a Trump-Clinton race since May, just 5 show Trump beating her, never by more than 5 percentage points. The most recent of those, a USA Today/Suffolk poll from mid-February, gave Trump a two-point advantage over Clinton. But five of the latest polls show Clinton ahead of Trump, including a brand-new survey from NBC and the Wall Street Journal that gives the former secretary of state a 13-point lead.

Sometimes, Trump just got facts wrong. He said the United States has a trade deficit with China of $500 billion a year. But for 2015, the deficit—that is, the difference between our imports and exports to and from China—was just under $366 billion. That’s the highest deficit to date, and it’s a figure that’s been growing for years, but it’s not $500 billion. Trump made a similar claim that the deficit with Japan is “over $100 billion,” but again, in 2015, it was closer to $68 billion.

The list goes on. Trump argued “nobody’s more conservative than me on health care”—this from the guy who praised the single-payer systems in Canada and Scotland and has cast himself as different from other Republicans on the issue because he, unlike them, does not want to see “people dying in the streets.”

If we can give Trump any credit for self-awareness when it comes to his lying, it’s that in one moment Tuesday, he corrected himself immediately. Ted Cruz “never beats me!” he said. Then, in the same breath, Trump added, “Meaning he rarely beats me.”

It’s a start.

A NEGLECTED ISSUE

I somehow missed the Washington Post Wonkblog story two years ago about the mal-distribution of alcohol consumption in this country, but here’s the gist of it:

The top 10 percent of drinkers account for well over half of the alcohol consumed in any given year. On the other hand, people in the bottom three deciles don’t drink at all, and even the median consumption among those who do drink is just three beverages per week.

In order to break into the top 10 percent of American drinkers, you would need to drink more than two bottles of wine with every dinner. And you’d still be below-average among those top 10 percenters.

First, I’m not doing nearly enough to keep my spot in the top 10 percent.

Second, what is Bernie Sanders going to do about this obvious inequality??

Christie’s Motivation. It’s Very Clear

Chris Christie is a ruthless politician who thinks only of himself and his quest for the White House. This motivation has now been shown in two  events.

The first was in September 2012 when he fell to his knees in front of Obama on a New Jersey Beach after Sandy, making Obama appear to be a leader in a time of crisis. His oleaginous embrace just six weeks before the election propelled Obama to a narrow victory over Mitt Romney.

Christie’s motivation was clear. He wanted no incumbent in the White House running in 2016 so he could.  He tanked his partie’s candidate to preserve his own ambition.

He has done the same by endorsing Donald Trump. Christie is hoping that  Trump loses to Hillary Clinton. He knows Rubio, Cruz or even John Kasich would beat Hillary in head to head elections They lead in polls now. In those elections, Hillary yes or no will be the issue, and Hillary will lose. In a Hillary-Trump election, Trump is the issue and he loses.

All of this is to preserve Christie’s path to  the White House. He cares nothing for the Country or for the Republican Party. He is all about Christie, all the time. It’s actually very sad, as he is so awful that he’ll never get to where he wants to go, and that’s the good news.

Alinsky Rules In SCOTUS Nominations

One of Saul Alinsky’s “Rules for Radicals” is that the other side must be made to play by its own rules. Hillary Clinton wrote her college thesis on Alinsky. The Democrats rules on SCOTUS nominations near the end of a President’s term are simple; No Hearings on SCOTUS nominations will occur. Senator Schumer in 2007 and then Senator Joe BIden in 1997  were very forceful in the application of this Democratic rule. Read more below.

Ever since the disgraceful treatment of Robert Bork’s nomination to the Supreme Court by Democrats, the GOP has played a sucker’s game. That has finally changed with the vacancy created by the death of Justice Antonin Scalia.  The Senate Judiciary Committee is playing by Democrat rules:

The Republican members of the Senate Judiciary Committee have officially declared they will not hold a hearing on anyone President Obama nominates for the Supreme Court.

In a letter [Tuesday], signed by all 11 Republicans on the 20-member committee, the members tell their Senate majority leader, Mitch McConnell of Kentucky, they will “not hold hearings on any Supreme Court nominee until after our next president is sworn in on January 20, 2017.”

“It’s not about the personality,” a committee member and Senate Majority Whip John Cornyn, R-Texas, told reporters today. “It’s about the principle.”

The Democrats are already feigning outrage, and have announced their plans to tell the Senate Republicans to “do their job.”

Go ahead, make my day.

We have videotape of Joe Biden, Chuck Schumer and Barack Obama all taking the position that the Senate should not vote to confirm a Republican in the lame duck era of a president’s term. They only convict themselves of hypocrisy with this stance. Read this Washington Examiner account of the ways in which the Dems have doomed themselves.

Now, defense of the Second Amendment is on the table as an issue, for a Democrat president almost certainly would appoint to the Court a justice who sees no individual right to possess firearms. For all the propaganda efforts of the left, the public is against them on this issue.

The same goes for abortion. Sensible restrictions, such as eliminating partial birth abortions, are supported by the public.

Europe Committing Suicide

Suicidal Overcompensation in Germany

Back in the days when Garrison Keillor was still funny, he told stories about the pioneering settlers who founded Lake Woebegon, Minnesota in the 19th century.  In the story, Norwegian immigrants settled in the coldest part of Minnesota because it reminded them of home – and then, when winter came, they remembered why they had left there in the first place.  German Catholics wandered into Lake Woebegon by mistake, “but they refused to admit it.”

So they stayed.

Today, Angela Merkel’s Germany is making another suicidal gesture by opening the borders to tens of thousands of predatory, war-indoctrinated jihadis – young men of military age, who have been taught to despise, hate, and beat up anybody outside their own Muslim sect.  They are indoctrinated in war theology – the last major war theology on Earth.  Merkel and the EU have drifted into this suicidal fiasco by mistake – but they still refuse to admit it.

It’s the German Catholics and Lake Woebegon again.  Sweden and Germany (especially Prussia) have a long folk reputation for getting completely stuck in whatever the current absolutist ideology happens to be.  This kind of fanatical belief led to centuries of bloody warfare between German-speaking Lutherans and Catholics.  Then it was Prussian imperialism with Frederick the Great and later Bismarck, who turned the independent provinces of Germany into one unified and self-glorifying Reich.  Prussian egomania turned into Karl Marx’s “philosophy” and Richard Wagner’s ideology in 1848; Marx preached revolutionary terror, and Wagner led directly to Hitler.  But the absolutist pathology over there was still the same.  Only the slogans changed.

Today Angela Merkel and the EU preach peace, peace, but they stupidly let in 50 million easily indoctrinated Muslims – so there will be no peace.  Isaiah (48:22) was right again.  The Swedes, Germans, and French still yearn for that Napoleonic absolutism, and the EU is always frantically denying that it plans to become another Roman Empire.

Methinks they do protest too much.

After Hitler and the Holocaust, West Germany had a long period of stability, under American defense guarantees, and many West Germans repented of the most disastrous mass regression in European history, the Nazi period.  At the same time, East Germany under Soviet control refused to take any responsibility for the Nazi past, including the ex-Nazis themselves.  It is difficult for human beings to confess to overwhelming guilt.  People who lived under Stalin had their own Holodomor and Siberian concentration camps, and humankind cannot bear much reality.

When the Berlin Wall went down around 1990, East and West Germany merged – two halves of a troubled country with totally different ideologies and blame for the past.  The unexpurgated ghosts of that past reared their ugly heads again.  Rational adult responsibility for Hitler turned into compulsive self-loathing, which was as insane in its own way as all the other absolutist beliefs of the past.  Multiculturalism took over as an irrational overcompensation for the sins of the fathers, who were long dead by the time the multicult took hold.

The biblical wisdom is that children cannot be blamed for the sins of the fathers.  Public guilt-tripping for the Holocaust was mighty convenient for the hard left, which never repented of 100 million victims of Marxist regimes in the 20th century (still growing in North Korea today).

Freud thought that mental illnesses were irrational exaggerations of normal emotions.  Paranoids suffer from intolerable suspicion about hidden forces, but there is such a thing as reasonable suspicion.  Severe depression is the extreme of normal sadness, driven by irrational perfectionism.  Anxiety disorders involve dysfunctional fears, but sane fear is a very healthy thing when a big truck is bearing down on you.  Islamophobia is a fantasy disease manufactured by the Organs of Propaganda, but legitimate fear of jihad is completely sane.

German-Swedish-French perfectionism and self-loathing are national manifestations of the same disorders we see in individuals.  If you’re haunted by deeply irrational self-loathing, insane fear, or suspicion, the answer is not to swing to the opposite extreme.  Psychotherapists see reaction formations like that all the time, and extreme emotional swings can destroy the road to health.

Still – Angela Merkel overcompensated to an insane extreme when she opened Europe’s borders to the closest thing to the Nazis since Hitler. This is a madness of Europe’s political elites.

ISIS is not at all different from the sadistic mass murders committed by the Nazis and by Stalin.  War ideologies are pretty much the same; only the uniforms, the hats, and the flags change.  What we see on ISIS murder videos is a bunch of adolescent males wearing Halloween outfits while they boast about murdering and abusing children and other innocents, who happen to believe in the wrong things.  The Hitler Jugend was an earlier manifestation of ISIS, with different hats and flags.  Human war cults are paranoid groups that shut out reality by mouthing the same stupid slogans over and over again until they themselves believe them.  Mao’s Red Guards killed their own teachers, Pol Pot targeted people wearing glasses, and Jim Jones did it with poisoned Kool-Aid.  His followers were ordinary people from San Francisco who were desperate for some meaning and purpose in their lives.  Murder cults are amazingly stereotypical.

The biggest mistake Europe’s ruling classes made was “multiculturalism”: glorifying dysfunctional tribal cultures and spreading hatred against the successful West and Christianity.  The multicult has now been denounced by Merkel, by Britain’s David Cameron, Tony Blair, and other big politicians, but you can’t wipe out decades of heavy indoctrination in one day.

The European and U.S. left wing hammered multi-cultism into millions of human heads, 24 hours a day, shoving it down in the schools and insisting on perverse glorification of violent tribal groups, like Muslim Somalis in Minneapolis.

The Multi Cult forbade rational thinking about importing violent Muslims and their hate-preaching imams.

The current wave of holy war began with the rise of OPEC in the 1970s, as per Mohammed’s specs from the Arabian desert 1,400 years ago.  Saudi super-billionaire Walid bin Talal has just promised another 35 million dollars for Muslim expansion in the West.  Holy struggle doesn’t have to be violent; if you kowtow to them completely, they are happy to accept your surrender.  But they’ll watch you ever after for good behavior, and walking away is punishable by death.

Jihad adapts its tactics to the enemy, but it never drops the goal of global conquest.  This is not a secret; our ruling classes and media are not as stupid as they pretend to be.

The European Union never has to face an election.  Eurosocialist politicians have lifetime tenure, and when they make ruinous mistakes, they always escape any blame.  The euro currency has been a catastrophe for the weaker economies of Europe – all except Germany and France.  Importing 50 million easily radicalized Muslims was a history-making suicidal blunder, but nobody is allowed to say so, even today.  Cannibalizing their defenses to feed the welfare state was yet another mind-boggling mistake.  In the real world, suicidal mistakes are punished by reality, or by other people.  Socialism evades any consequences.

When Obama withdrew U.S. protection, Europe suddenly became vulnerable to Putin and jihad.  Even so-called “conservative” (i.e., sane) newspapers over there can’t bring themselves to tell the truth.  The EU and its national elites own the media.  Not all Europeans are blind to these gross, delusional mistakes.  Millions of people see it happening, and they are afraid.  But this bunch of Eurosocialist rulers are just as deaf and dumb as the Soviet apparatchiks were.  They can see their delusions crumbling, but they can’t stop it.

The EU has a perfect formula for endemic corruption and betrayal, and Muslim regimes have always practiced political baksheesh.  All the Saudis had to do was to import their own ancient political culture along with the mosques they built all over the place.  Under Multi-Cult Jacques Chirac, Dominique de Villepin and Kofi Annan took big money from Saddam Hussein, money that was intended to feed Iraqi children.  Nicolas Sarkozy took 50 million dollars from Moammar Gaddafi.  Helmuth Kohl sold out to Putin’s Gazprom, the Russian energy giant.  The media shut their eyes.

Today the London Daily Telegraph claims that 261 British politicians are directly implicated in child sexual abuse rings in the U.K., but they are never exposed.  The BBC covered up their own child sex abuse scandal for decades.  Every writer about Islam has known that underage sexual abuse is endemic in the Muslim world, following the example of the perfect man, Mohammed.  Occasionally another “Asian” (Muslim) child abuse gang is arrested in the U.K., but the cops can never catch up.  They can’t even go into no-go zones in London.  Nobody can purge the rot, because everybody is either on the take or open to blackmail.

The Cambridge Spy Ring of the 1930s were gay college students who were easily suborned by the KGB.  Today gay sex is legal, but child abuse is not, and to hostile regimes it’s an obvious blackmail trick.  In the U.S., Bill Clinton was caught going to Jeffrey Epstein’s Lolita Island off the Florida coast, and yes, Mr. Epstein did have videocams recording what was going on.

Nobody has ever told the U.S. public all the blackmail possibilities, but we know that unidentified hackers have stolen hundreds of personal identities of many federal officials.  Hillary and Huma’s email scam was a wide open invitation for predatory hackers from Russia, Iran, China, Israel, the EU, and all the rest.  Once you can read hundreds of Hillary’s SecState emails, it’s a lot easier to break into more secure systems.

Any sentient person now knows that Obama and Hillary are Eurosocialists.  Chicago is a sort of Eurosocialist political machine.  Obama’s mentor is Emil Jones, the “godfather” of the Illinois Machine, and Michelle’s father was a Chicago ward boss.  Chicago is also a baksheesh culture.  It makes Chicago Muslims feel right at home.

Europe is still the second richest economy per capita, with more than 300 million productive people.  It still has no serious defensive capacity, because Uncle Sam took care of all that – until Obama pulled out the rug.  Now Europe has sacrificed any serious defense capacity, and Uncle Sam has walked off.

Europe has been emasculated by two generations of anti-male, anti-realist, fantasy propaganda.  The last time I spent some time in Denmark and Sweden, the gay scene – both male and female – seemed to be all the rage.  I don’t have statistical evidence, but it’s easy to see.

When Obama gave his first “Look at me, citizens of the world!” speech in Berlin in 2008, he first wanted to talk at the Brandenburg Gate.  Instead, the Germans proposed the Siegesaule Platz, the center of the gay scene in Berlin.  Maybe it was the mayor’s sense of humor.  American television audiences didn’t get a chance to see Obama’s audience, but the scuttlebutt was that that nude gay couples were enjoying the sunshine on the grass while Obama paraded his ego.

But Merkel’s ground-kissing bow to the rapefugees tells us that Europe still hasn’t found a sane political balance.

Methinks they do protest too much.

The biblical wisdom is that children cannot be blamed for the sins of the fathers.  Public guilt-tripping for the Holocaust was mighty convenient for the hard left, which never repented of 100 million victims of Marxist regimes in the 20th century (still growing in North Korea today).

Freud thought that mental illnesses were irrational exaggerations of normal emotions.  Paranoids suffer from intolerable suspicion about hidden forces, but there is such a thing as reasonable suspicion.  Severe depression is the extreme of normal sadness, driven by irrational perfectionism.  Anxiety disorders involve dysfunctional fears, but sane fear is a very healthy thing when a big truck is bearing down on you.  Islamophobia is a fantasy disease manufactured by the Organs of Propaganda, but legitimate fear of jihad is completely sane.

German-Swedish-French perfectionism and self-loathing are national manifestations of the same disorders we see in individuals.  If you’re haunted by deeply irrational self-loathing, insane fear, or suspicion, the answer is not to swing to the opposite extreme.  Psychotherapists see reaction formations like that all the time, and extreme emotional swings can destroy the road to health.

Still – Angela Merkel overcompensated to an insane extreme when she opened Europe’s borders to the closest thing to the Nazis since Hitler. This is a madness of Europe’s political elites.

ISIS is not at all different from the sadistic mass murders committed by the Nazis and by Stalin.  War ideologies are pretty much the same; only the uniforms, the hats, and the flags change.  What we see on ISIS murder videos is a bunch of adolescent males wearing Halloween outfits while they boast about murdering and abusing children and other innocents, who happen to believe in the wrong things.  The Hitler Jugend was an earlier manifestation of ISIS, with different hats and flags.  Human war cults are paranoid groups that shut out reality by mouthing the same stupid slogans over and over again until they themselves believe them.  Mao’s Red Guards killed their own teachers, Pol Pot targeted people wearing glasses, and Jim Jones did it with poisoned Kool-Aid.  His followers were ordinary people from San Francisco who were desperate for some meaning and purpose in their lives.  Murder cults are amazingly stereotypical.

The biggest mistake Europe’s ruling classes made was “multiculturalism”: glorifying dysfunctional tribal cultures and spreading hatred against the successful West and Christianity.  The multicult has now been denounced by Merkel, by Britain’s David Cameron, Tony Blair, and other big politicians, but you can’t wipe out decades of heavy indoctrination in one day.

The European and U.S. left wing hammered multi-cultism into millions of human heads, 24 hours a day, shoving it down in the schools and insisting on perverse glorification of violent tribal groups, like Muslim Somalis in Minneapolis.

Today the London Daily Telegraph claims that 261 British politicians are directly implicated in child sexual abuse rings in the U.K., but they are never exposed.  The BBC covered up their own child sex abuse scandal for decades.  Every writer about Islam has known that underage sexual abuse is endemic in the Muslim world, following the example of the perfect man, Mohammed.  Occasionally another “Asian” (Muslim) child abuse gang is arrested in the U.K., but the cops can never catch up.  They can’t even go into no-go zones in London.  Nobody can purge the rot, because everybody is either on the take or open to blackmail.

Trump Named in 169 Federal Lawsuits

We Investigated, Donald Trump is Named in at Least 169 Federal Lawsuits

shutterstock_322465685Donald Trump has been named in at least 169 federal lawsuits, according to a LawNewz.com investigation. They read like a history of  Trump’s business failures, successes, and bombastic personality. With Trump threatening a lawsuit against Ted Cruz, his surge in the polls, and his big win in New Hampshire, we thought now was as good a time as any to review of some of the Donald’s legal skirmishes. The federal lawsuits that we reviewed date back to 1983 and involve everything from business disputes, antitrust claims and, more recently, accusations that Trump’s campaign statements are discriminatory against minorities. Some of the cases have been resolved, some were dismissed as frivolous, and others were privately settled. He’s been sued by celebrities, personal assistants, prisoners, people in mental hospitals, unions, and wealthy businessmen. Of course, Donald Trump has also done his fair share of suing as well.  The lawsuits on both sides provide a unique glimpse into some of the biggest battles involving the presidential candidate.  Just a note, the cases listed below only include those filed in U.S. federal court. Who knows how many others were filed in state courts around the country.

Here are some highlights in chronological order:

  • The U.S. Department of Justice sued Trump for an antitrust violation in 1988 and won. Trump was forced to pay $750,000. The real-estate magnate agreed to pay the penalty stemming from his attempted takeovers of two companies. The feds said that his stock purchases in the companies violated the FTC’s notification requirements.
  • 1990 was a big legal year for Donald Trump. He was named as a defendant in 21 lawsuits filed by different businesses and individuals. Several sued him for securities fraud and breach of contract. Most of the complaints stem from the Trump’s corporation filing for Chapter 11 bankruptcy from creditors following the building of the Taj Mahal Casino in Atlantic City, New Jersey. By 1991, the resort was nearly $3 billion in debt, according to the New York Times.
  • It’s not just Trump being sued. He has sued Palm Beach, where he has a home, at least three different times. In 1992, he filed a $100 million lawsuit over the membership club Mar-a-Lago, the council eventually “acquiesced” and allowed him to make some of his property into a private club. He then sued the Palm Beach Airport for noise violations, and tried to prevent them from expandingnear his private club. Palm Beach County estimates that legal fights with Trump related to the airport have cost taxpayers at least $600,000. The most entertaining is probably the $25 million lawsuit he filed against the town, who cited him for displaying an American flag on his property. “The town council of Palm Beach should be ashamed of itself,” Trump said, according to Politico. “They’re fining me for putting up the American flag. This is probably a first in United States history.”
  • In 1995, the personal assistant to Donald Trump’s ex-wife Marlafiled a federal lawsuit against them that went on for years. It readslike an article in the National Inquirer, with accusations of nude pictures being sent to tabloids, and panty stealing. In 2003, a judge finally dismissed the case, calling the plaintiff’s case full of “ramblings.”
  • A New Hampshire man, upset he didn’t appear on Trump’s reality show The Apprentice, sued for allegedly discriminating against an older contestant. The 51-year-old withdrew his lawsuit after entering into a settlement agreement, according to Law 360.
  • A college student filed a lawsuit against Trump’s profit seeking college, Trump University, and a federal judge eventually ordered the school pay $798,000 in legal fees, according to Courthouse News. The student claimed the university and Trump engaged in deceptive practices, and that the seminars were nothing more than infomercials. Trump’s name was eventually dropped from the suit.
  • Rafel Oliveras and Lopez De Victoria who live in Puerto Rico filed a lawsuit last year.  The duo claim “Candidate Donald Trump publicly disgraced and discriminated against Hispanics by wholesale comparing them with murderers, rapists and known gang members.” The couple wants him barred him from seeking the office of President of the United States all together. Good luck, with that one.
  • The most recent lawsuit was filed in December by Federick Banks — who says he is an American Indian Witch. He also sued the CIA director.

Shumer’s 543 Day Delay

This past Sunday on This Week with the former Clinton enabler, the odious Senator Chuck Schumer instructed us in course to be followed in connection with the replacement of Justice Scalia on the Court: “Well, the job, first and foremost, is for the president to nominate and for the Senate to hold hearings and go through the process. You know, the Constitution, Ted Cruz holds the Constitution, you know, when he walks through the halls of Congress. Let him show me the clause that says president’s only president for three years.” The former Clinton enabler let Schumer’s instruction stand without any of the variety of challenges that might be made on the merits.

At Mediaite, Alex Rodriguez calls attention to one challenge that applies specifically to Schumer: “Schumer took the exact opposite stance nine years ago, going out of his way to bluntly tell the George W. Bush administration that he would filibuster any Supreme Court nominee they put forward in the next two years because he didn’t care for the ideology of his previous two nominees.” Rodriguez posts the video below from Schumer’s speech to the American Constitution Society, no less, and dryly observes: “This speech was delivered July 27, 2007. So Schumer – who now balks at the idea of a 300-day delay in appointing a Justice – would have been perfectly okay with filibustering a Supreme Court nominee for 543 days.” Curt Mills makes the same point at the Examiner, as does Ed Morrissey at Hot Air and others elsewhere. It can’t be made too often.
